1. Overview
These Terms of Service govern your use of carhappy.jp and any purchase made through CarHappy (operated by 株式会社卓越移動). By using our website or placing an order, you agree to these terms.
2. Vehicle Listings
- All vehicles are sourced from Japanese auctions and authorised dealers
- Prices shown are FOB (Free on Board) Japan unless stated otherwise
- Shipping, insurance, and destination port charges are calculated separately
- Vehicle availability is subject to change; we confirm stock before processing payment
- Photos shown are representative of the vehicle condition at time of listing
3. Orders and Payment
- A $99 USD refundable deposit is required to reserve a vehicle
- The deposit is fully refunded if we cannot source the agreed vehicle
- Balance payment is due before the vehicle is shipped from Japan
- We accept bank transfer, mobile money (Kenya/Uganda), and XTRANSFER
- All prices are quoted in USD; exchange rates apply for local currency payments
4. Shipping and Delivery
- Shipping is arranged from Osaka, Kobe, or Yokohama port to your destination port
- Estimated transit times are provided at the time of order and are not guaranteed
- Risk of loss transfers to the buyer once the vehicle is loaded onto the vessel (FOB terms)
- We assist with all export documentation from Japan
- Import duties, taxes, and clearing fees at the destination port are the buyer's responsibility
5. Inspection and Condition
All vehicles are inspected in Japan before shipment. Auction grade reports are provided where available. CarHappy does not provide warranties on used vehicles beyond what is stated in the individual vehicle inspection report.
6. Cancellations and Refunds
- Cancellations before vehicle purchase in Japan: full deposit refund
- Cancellations after vehicle purchase but before shipping: deposit forfeited; additional costs may apply
- Cancellations after shipping: not accepted
7. Limitation of Liability
CarHappy's liability is limited to the amount paid by the buyer for the specific vehicle. We are not liable for consequential losses, including loss of business income, arising from delays or vehicle defects discovered after delivery.
8. Governing Law
These terms are governed by the laws of Japan. Disputes will be resolved through good-faith negotiation. If unresolved, disputes will be submitted to the courts of Osaka, Japan.
